In New York you can go topless, as long as you aren't doing it for advertising purposes, or to turn people on (that's INTENT to turn on, not what actually happens). The most a cop can do is inform you that your action is ill-advised, and ask if you would please reconsider. I expect there must be some sort of exception for doing it in a school zone or outside a senior citizen complex, but I've never heard of one.
